Access to Local Water Utility (LWU) Regulatory Approvals has been improved on the NSW SEED Open Data Portal, making it easier to find, navigate and access Notices of Determination for treatment works approvals across regional NSW.

The collection provides public access to Notices of Determination for water treatment, sewage treatment and recycled water works.

Making these regulatory approvals available as Open Data provides greater transparency around treatment works approved under section 60 of the Local Government Act 1993 or section 292(1) of the Water Management Act 2000, and makes it easier for the public, local water utilities and other interested users to find and access this information.

The LWU Regulatory Approvals collection has been reorganised into a clear hierarchy by calendar year and treatment works category:

LWU REGULATORY APPROVALS

Treatment Works Approvals – YYYY (parent dataset)

 → Water Treatment Works (child dataset)

 → Sewage Treatment Works (child dataset)

 → Recycled Water Works (child dataset)

Each yearly parent dataset provides an overview of the approvals for that calendar year, with its related child datasets providing access to the relevant Notices of Determination as downloadable PDF resources. The collection currently covers 2022 to 2026 and will continue to expand as future approvals are published.

The Notices of Determination are also linked through the department's Treatment works approval status webpage, which provides information on the assessment status and approval outcomes for treatment works applications. Through the SEED Open Data Portal, the Notices are organised by calendar year and treatment works category for public access and download.

Works that need approval under section 60 of the Local Government Act or section 292(1)(a) of the Water Management Act. Under section 60 of the Local Government Act and section 292(1)(a) of the Water Management Act, the Minister responsible for administering the Act is responsible for approving local water utility works, including: - construction or extension of water treatment works by a council (section 60(b) of the Local Government Act) - provision of sewage from its area to be discharged, treated, or supplied to any person by a council (section 60(c) of the Local Government Act) - construction, maintenance, and operation of water management works and other associated works (including water treatment works and sewage works) by a water supply authority (section 292(1)(a) of the Water Management Act). In this section, sewage and water management works include works for producing recycled water from sewage. The Minister responsible for administering the Act has delegated the responsibility for assessing and approving applications made under section 60 of the Local Government Act and section 292(1)(a) of the Water Management Act to the department. ----------------------------------- The approvals are organised into the following categories: ### Water Treatment Works Section 60(b) Local Government Act / (section 292(1)(a) of the Water Management Act). This includes infrastructure and facilities involved in the treatment, supply, and management of water. ### Recycled Water Works Section 60(c) Local Government Act / (section 292(1)(a) of the Water Management Act).
